Spam

Spam is a nuisance that we could all do without and there are answers. The first line of defence is to have a private address that is not obvious. John Smith@hotmail.com does not qualify. A second answer is  not to answer them ever.

Counter attacking through the Small Claims Court is a great way to go. It worked for Gordon Dick after a firm sent him an unsolicited email. Damages of  £750 sound useful. The perpetrators haven't coughed up yet so it will take longer and cost THEM more. They have spent money on a lawyer. Then there is time and trouble involved. The publicity is something they could do without.

After using a lawyer and losing they are claiming ignorance. Believe them if you want. See the story at Court victory for man who took on spammers or go to his web site at Scotch Spam!
PS The spam industry is thriving. They are even sending out spam to find buyers - one of them is at peterwilson2001@163.com?subject=worldwideemails

Take note that:-

The Privacy and Electronic Communications (EC Directive) Regulations 2003  prohibit companies from sending marketing e-mails, texts, or faxes to individuals.

They are allowed to send e-mail messages, however, if an individual has consented to receiving them on a particular e-mail address.

Section 22 was written by a pompous rogue but the intent is moderately clear notwithstanding.

 

By some happy chance aforesaid regulations are on line. Finding them is easy. The ball is in your court.

  • 1. Not to have their personal email addressed processed or stored without consent.
  • 2. Not to receive marketing email without explicit consent unless it is related to an existing relationship with the company and you have not withdrawn consent.

This boils down to the proposition that they are not allowed to send you spam without your consent.
